ORDER


On the 1st day of August, 2003, came the Respondent, Troy Aurelius Titus, by his counsel, David Ross Rosenfeld, Esq., and Richard E. Slaney, Assistant Bar Counsel, on an Agreed Disposition previously filed with the Clerk of the Disciplinary System. The parties appeared before the Honorable Roscoe B. Stephenson, III, Chair of the Disciplinary Board and presiding Board member, Chester A. Cahoon, Jr., Bruce T. Clark, Peter A. Dingman and Robert E. Eicher by telephone conference call, and the parties moved that the Board accept the Agreed Disposition. The parties also orally modified the Agreed Disposition to change the sanction from a $5,000 penalty to a $5,000 penalty and an Admonition, to change the word "fine" to the word "penalty" and to change the word "Subcommittee" to "Board." These modifications were accepted by the Board, and the matter was argued by counsel.

The Board then deliberated and unanimously voted to accept the Agreed Disposition, as modified. In accordance with the Agreed Disposition, as modified, the Board hereby

ORDERS that the Respondent pay a penalty of $5,000 for his violation of the Virginia Consumer Real Estate Settlement Protection Act (CRESPA) as detailed in the Agreed Disposition, a copy of which is attached to this Order and incorporated herein by this reference; and further, the Board

ADMONISHES the respondent for said CRESPA violation. It is further

ORDERED that a true copy of this Order be mailed, postage prepaid, to Troy Aurelius Titus, Esq., at his address of record with the Virginia State Bar, 5221 Indian River Road, Virginia Beach, Virginia 23464, to his counsel, David Ross Rosenfeld, Esq., at 118 South Royal Street, Alexandria, Virginia 22314 and hand delivered to Richard E. Slaney, Assistant Bar Counsel, Virginia State Bar, 707 East Main Street, Suite 1500, Richmond, Virginia 23219.
